Workplace Discrimination Cases On The Rise

Newly released figures show, discrimination claims against bosses dramatically climbed by about a third last year.

Nearly half of all workplace cases are race-related while complaints about age discrimination have more than doubled.

Overall, 85 percent of complaints made to the tribunal last year were workplace related, according to Melanie Pine, director of The Equality Tribune.

“The employment cases coming into the tribunal are widely varied, covering many aspects of working life from start to finish,” she said. “Many of these are complicated and involve several issues and usually more than one person.”

The Equality Tribunal is the impartial forum to hear or mediate complaints of alleged discrimination under equality legislation. It is independent and quasi-judicial and its decisions and mediated settlements are legally binding.

Ohio Supreme Court Allows Workplace Discrimination Case Against City to Proceed

Former Fire Chief Michael Dworning was granted approval to proceed with a workplace discrimination lawsuit against the city.

The Ohio Supreme Court’s decision on Tuesday, upheld a previous ruling by the 8th Ohio District Court of Appeals which agreed that Dworning’s civil lawsuit could move forward without first going through the city’s Civil Service Commission.

The city along with a Cuyahoga County Common Pleas judge had argued - that city employees such as Dworning were required to complete an administrative appeals process before taking civil action against the city involving employment issues.

Chris Frey, City Law Director, was unhappy with Tuesday’s ruling. The city will attempt to settle the case out of court, he said.

Dworning sued the city and several others in 2004, alleging he was fired because of a disability, in violation of the city’s anti-discrimination provisions.

But city officials dispute Dworning's claim that he was fired. Frey said Dworning retired and has collected in excess of $60,000 of retirement benefits that he would not have gotten had he been fired.

Originally posted at InjuryBoard by Chrissie Cole

MDL CEO convicted in Ohio investor loss

A Pittsburgh hedge fund manager was convicted Tuesday of defrauding Ohio's workers' compensation system.

Mark Lay, CEO of MDL Capital Management, faces up to 20 years in prison for investment advisory fraud, mail fraud and conspiracy to commit mail and wire fraud.

The charges were linked to the loss of $216 million he invested for the Ohio Bureau of Workers' Compensation in a highly-leveraged hedge fund without authorization.

Prosecutors contended that Lay took risks far greater than allowed by his agreement with the BWC and concealed what he was doing from the BWC's investment staff.

Lay's attorney claimed that a poor investment choice did not constitute a crime.

Lay was charged along with several others in connection with an investigation into BWC investments sparked by GOP fund-raiser Tom Noe's theft from a $50 million rare-coin fund that he handled for the agency.

For more information on this subject, please refer to the section on Workers Compensation.

Originally posted at InjuryBoard by Richard Schulte

Annette Brown takes on City Hall

City of Dayton Employee Annette Brown has a college degree, an MBA, and had worked in finance for 6 years. Until recently she was a dedicated civil servant. Now the City has placed her on administrative leave and she faces a hearing on August 27th to terminate her employment because the City of Dayton claims she is in violation of the city charter requiring that she "reside" and "live" within the City of Dayton.

Mrs. Brown owns a house in the City of Dayton and another in Harrison Township. She also pays taxes, pays utilities, and votes in the City. She has split time between the two residents and recently has spent most of her nights in the City of Dayton house but fears that this will not be enough to save the job she loves. According to Mrs. Brown they have "gone to far by hiring private investigators to follow me and my family around like drug dealers and this is not what our tax dollars should be spent on", "how can it be fair that your employer can follow you night and day". Mrs. Brown is not taking this matter lying down. She hired Dayton Attorney Richard Schulte who filed a lawsuit asking that the cities charter be held unconstitutional and that a restraining order be issued prohibiting the City form enforcing the charter provision. Ohio Attorney General Marc Dann was also named as a defendant in the suit. That hearing should be had in the coming weeks.

For more information on this subject matter, please refer to the section on Workplace Injuries and Discrimination.

Originally posted at InjuryBoard by Richard Schulte
