      <title>Flour Tortillas Recalled By Pop's Bakery</title>
      <description>&lt;p&gt; &lt;/p&gt;
&lt;p&gt;Pop&amp;rsquo;s Bakery, of Texas, announced a voluntary &lt;a href="http://www.fda.gov/Safety/Recalls/ucm188156.htm"&gt;recall of all flour tortillas&lt;/a&gt; because they contain undeclared whey (milk). People who have an allergy to whey run the risk of serious or life-threatening allergic reaction if these products are unknowingly consumed.&lt;/p&gt;
&lt;p&gt;To this date, there have been no illnesses associated with the recall.&lt;/p&gt;
&lt;p&gt;&lt;b style=""&gt;The following number codes are included in the recall:&lt;/b&gt;&lt;/p&gt;
&lt;p&gt;110609, 110509, 110409, 110309, 110209, 110109, 103109, 103009, 102909, 102809, 102709, 102609, 102509, 102409, 102309, 102209, 102109, 102009, 101909, 101809, 101709, 101609, 101509, 101409, 101309, 101209, 101109, 101009, 100909, 100809, 100709.&lt;/p&gt;
&lt;p&gt;The recalled tortillas were distributed within the state of Texas to restaurants and grocery stores. The product label says &amp;ldquo;POP&amp;rsquo;S BAKERY HOME STYLE FLOUR TORTILLAS.&amp;rdquo;&lt;/p&gt;
&lt;p&gt;Consumers are urged to contact the company directly with any questions at 1-325-655-1170 or 1-325-374-5392 during the hours of 9:00 am &amp;ndash; 3:00 pm Monday through Thursday.&lt;/p&gt;

      <title>Fluke Recalls Digital Clamp Meters</title>
      <description>&lt;p&gt; &lt;/p&gt;
&lt;p&gt;&lt;a href="http://www.fluke.com/33Xrecall"&gt;Fluke Corp&lt;/a&gt;., in conjunction it the U.S. Consumer Product Safety Commission (CPSC), has announced a recall of more than 52,000 &lt;a href="http://www.cpsc.gov/cpscpub/prerel/prhtml09/09222.html"&gt;Fluke Digital Clamp Meters&lt;/a&gt;.&lt;/p&gt;
&lt;p&gt;The meters can fail to give a correct voltage reading, which can result in the user falsely believing the power is off, posing a shock, electrocution or thermal burn hazard.&lt;/p&gt;
&lt;p&gt;To date, the company has not received any reports of injury but has received three reports of the meters displaying an incorrect voltage reading.&lt;/p&gt;
&lt;p&gt;The recall involves Fluke Digital Clamp Meters with the model and serial numbers listed below. The model number may be followed by an &amp;ldquo;A.&amp;rdquo;&lt;/p&gt;

      <title>Cleveland Jail Proposes New Drug Policy</title>
      <description>&lt;p&gt; &lt;/p&gt;
&lt;p&gt;The death of R&amp;amp;B singer &lt;a href="http://en.wikipedia.org/wiki/Sean_Levert"&gt;Sean Levert&lt;/a&gt; in Cleveland has led to a proposed new policy that would provide more flexibility in giving inmates their prescription anti-anxiety medications.&lt;/p&gt;
&lt;p&gt;Levert died March 30, 2008 while in Cuyahoga County Jail. He was serving a sentence for failure to pay child support.&lt;/p&gt;
&lt;p&gt;The jail doctor and jail administrator propose allowing inmates to get drugs as soon as their prescriptions can be verified. The drug in question goes by the trade name Xanax.&lt;/p&gt;
&lt;p&gt;In June, Angela Lowe, Levert&amp;rsquo;s widow, filed a &lt;a href="http://www.freep.com/article/20081220/NEWS07/81220063/1009"&gt;wrongful death lawsuit&lt;/a&gt; alleging county jail officials of neglecting his medical needs.&lt;/p&gt;
&lt;p&gt;The suit claims that Levert suffered severe anxiety and that he brought his Xanax prescription to jail but was not given his medication.&lt;/p&gt;

      <title>Workplace Discrimination Cases On The Rise</title>
      <description>&lt;p&gt; &lt;/p&gt;
&lt;p&gt;Newly released figures show, &lt;a href="http://www.google.com/hostednews/ukpress/article/ALeqM5g3uGdsGrOlTJ5AgJ5empZlXdzmpw"&gt;discrimination claims against bosses&lt;/a&gt; dramatically climbed by about a third last year.&lt;/p&gt;
&lt;p&gt;Nearly half of all workplace cases are race-related while complaints about age discrimination have more than doubled.&lt;/p&gt;
&lt;p&gt;Overall, 85 percent of complaints made to the tribunal last year were workplace related, according to Melanie Pine, director of &lt;a href="http://www.equalitytribunal.ie/"&gt;The Equality Tribune&lt;/a&gt;.&lt;/p&gt;
&lt;p&gt;&amp;ldquo;The employment cases coming into the tribunal are widely varied, covering many aspects of working life from start to finish,&amp;rdquo; she said. &amp;ldquo;Many of these are complicated and involve several issues and usually more than one person.&amp;rdquo;&lt;/p&gt;

      <title>One Injured In RTA Bus Crash In Dayton</title>
      <description>&lt;p&gt; &lt;/p&gt;
&lt;p&gt;A multi-vehicle &lt;a href="http://www.daytondailynews.com/blogs/content/shared-gen/blogs/dayton/daytoncrime/entries/2009/09/03/one_sent_to_hospital_in_rta_bu.html"&gt;accident involving an RTA bus&lt;/a&gt; yesterday afternoon is being investigated by officers.&lt;/p&gt;
&lt;p&gt;The accident happened at the intersection of Edwin C. Moses Blvd. and Albany Street near Interstate 75.&lt;/p&gt;
&lt;p&gt;According to officials, at least one person was removed from the accident and transported to Miami Valley Hospital. Details regarding the person&amp;rsquo;s injuries are unknown at this time.&lt;/p&gt;
&lt;p&gt;Officials are unclear as to what caused the accident. The investigation is ongoing.&lt;/p&gt;
&lt;p&gt;In May, the &lt;a href="http://dayton.injuryboard.com/wrongful-death/rta-wrongful-death-suit-settled-.aspx?googleid=263796"&gt;RTA &lt;b&gt;settled a wrongful death suit&lt;/b&gt;&lt;/a&gt;&lt;b&gt; &lt;/b&gt;with the family of a Cleveland man who died after he was struck by a commuter bus while walking in the crosswalk.&lt;/p&gt;

      <title>Elderly Driver Crashes Into State Highway Patrol Car</title>
      <description>&lt;p&gt; &lt;/p&gt;
&lt;p&gt;A driver, 76, is in critical condition at Miami Valley Hospital after &lt;a href="http://newstalkradiowhio.com/localnews/2009/09/update-driver-critical-after-h.html"&gt;hitting a State highway Patrol cruiser&lt;/a&gt; Thursday night.&lt;/p&gt;
&lt;p&gt;Officer Kyle Pohlabel&amp;rsquo;s cruiser was stopped at a construction zone on I-75 when David Catlett struck his cruiser at a high rate of speed.&lt;/p&gt;
&lt;p&gt;The officer was in the far left lane with his overhead warning lights on and flashing, blocking off a lane as construction workers did overnight work, according to state Patrol supervisors.&lt;/p&gt;
&lt;p&gt;Officer Pohlable has been treated and released from the hospital, he is recovering at home.&lt;/p&gt;
&lt;p&gt;Officers suspect Catlett may have suffered a medical condition prior to the accident. The investigation is ongoing.&lt;/p&gt;

      <title>Melon Acres Recalls Canteloupes for Possible Salmonella Risk</title>
      <description>&lt;p&gt; &lt;/p&gt;
&lt;p&gt;Melon Acres &lt;a href="http://www.fda.gov/Safety/Recalls/ucm180800.htm"&gt;recalled cantaloupes&lt;/a&gt; at several Midwest locations including Greenwood, Indiana, Lansing, Michigan, and Tipp City, Ohio due to a possible risk of salmonella contamination.&lt;/p&gt;
&lt;p&gt;The recall was announced August 27 on the U.S. Food and Drug Administration (FDA) Web site.&lt;/p&gt;
&lt;p&gt;As of this date, no illnesses have been associated with the recalled cantaloupe, according to the news release.&lt;/p&gt;
&lt;p&gt;The agency tested the melons on August 11. They found one of twenty tested positive for salmonella. The findings were reported to Melon Acres on August 21.&lt;/p&gt;
&lt;p&gt;Salmonella is frequently the culprit behind food-borne illnesses. Symptoms of salmonella contamination include fever, diarrhea, nausea, vomiting, and abdominal pain. Generally, symptoms appear within 12 hours to 72 hours of eating tainted food. Infants, the elderly, and those with weakened immune systems are more likely than others to develop severe illness.&lt;/p&gt;

      <title>Strattera patent challenged</title>
      <description>&lt;p&gt;The patent on hyperactivity-disorder drug &lt;a href="http://www.strattera.com/1_1_about_strattera/1_1_about.jsp"&gt;Strattera&lt;/a&gt; is being challenged by Novartis AG's Sandoz unit.  Novartis is seeking a pre-emptive ruling that its proposed generic version of Strattera won't infringe a Lilly patent that expires in 2017, or that the patent is invalid.&lt;/p&gt;&lt;p&gt;Icelandic drugmaker Actavis Group hf is already being sued by Lilly to block a generic version of Strattera, which generated $282.2 million in sales for the first half of the year for Lilly.       <description>&lt;p&gt;A doctor in Ohio practices medicine without Medical Malpractice insurance because he feels that the insurance is both, too expensive, and simply an avenue by which patients bring frivolous claims in pursuit to make themselves rich.  According to area attorneys, this doctor has made himself &lt;a href="http://www.daytondailynews.com/n/content/oh/story/news/local/2007/07/21/ddn072207malpracticeinside.html?cxtype=rss&amp;cxsvc=7&amp;cxcat=16"&gt;"judgment proof"&lt;/a&gt; by placing his assets in a family trust and, therefore, protecting such assets from civil lawsuits.  Dr. David Fallang has been involved over 22 lawsuits and still refuses to pay for medical malpractice insurance.  Although such conduct by a medical doctor seems to fall far outside of the law, Ohio law currently allows doctors to practice without Medical Malpractice Insurance, subject to some restrictions.&lt;/p&gt;&lt;p&gt;Currently, as a family mourns the loss of a loved one, Dr. Fallang has once again "shielded himself from judgment."  &lt;/p&gt;&lt;p&gt;&lt;blockquote&gt;While malpractice insurance isn't required, Ohio law mandates that physicians who lack the insurance inform patients in writing and obtain a signed consent form prior to treatment in non-emergency cases.&lt;/p&gt;&lt;p&gt;The Middletown resident admits "I'm not perfect," but he doesn't believe any of the cases against him involved actual malpractice. He said the suits were largely manufactured by the "medical malpractice lawsuit industry."&lt;/p&gt;&lt;p&gt;"I've just been squashed by this stuff," said Fallang, former medical staff president at Middletown Regional Hospital. "And let me tell you, I'm a pretty damn good surgeon."&lt;/p&gt;&lt;p&gt;Malpractice and the law&lt;/p&gt;&lt;p&gt;Failure to disclose a lack of malpractice insurance isn't a crime in Ohio, but it's subject to disciplinary action by the State Medical Board of Ohio. Penalties include a reprimand up to a permanent revocation of the physician's medical license.&lt;/p&gt;&lt;p&gt;"To be perfectly blunt, I don't believe that it's my responsibility to make my patients rich if there should be an adverse occurrence," Fallang said. "My responsibility is to take the best medical care of them that I know how."&lt;/p&gt;&lt;p&gt;"No one can do surgery with zero complications, it's just not physically possible," he said. "Medical malpractice lawsuits, 95 percent of the time, are about money, they're not about malpractice."&lt;/blockquote&gt;&lt;/p&gt;&lt;p&gt;This may be difficult, however, for the family of Linda Wilson to understand.  Linda Wilson, who was recently a patient of Dr. Fallang's, suffered catastrophic and fatal complications due to her gastric bypass surgery.  &lt;/p&gt;&lt;p&gt;&lt;blockquote&gt;Patrick Wilson can't remember how much his wife weighed, but said she sought the surgery in 1999 to lose weight and get a handle on her diabetes.&lt;/p&gt;&lt;p&gt;[Linda Wilson] lost around 120 pounds initially, Wilson recalled, but problems soon arose. Fallang said he tried to talk the Wilsons out of a second operation, that it was risky, but he relented.&lt;/p&gt;&lt;p&gt;He said the complication that led to Linda Wilson's death -- a rare, massive blood clot called a hemobezoar that obstructed her bowel -- was beyond his control.&lt;/p&gt;&lt;p&gt;"Mr. Wilson never should have sued me," Fallang said. "It was immoral of him to do so, in my opinion, because I didn't kill his wife. His wife had a rare and unfortunate complication, one that was not foreseeable.       <title>Man Killed In Motorcycle Accident In Dayton</title>
      <description>&lt;p&gt; &lt;/p&gt;
&lt;p&gt;A motorcyclist was killed Thursday night when he &lt;a href="http://newstalkradiowhio.com/localnews/2009/08/third-street-shut-down-for-fat.html"&gt;crashed his motorcycle&lt;/a&gt; on West Third Street at Ardmore Avenue.&lt;/p&gt;
&lt;p&gt;Third Street &amp;ndash;in both directions - was shut down for several hours following the accident. The man, 40, was pronounced dead at the scene.&lt;/p&gt;
&lt;p&gt;The accident happened when the motorcyclist tried to pass a car at the intersection of Ardmore and Third, but he struck the front bumper of the other vehicle. He was thrown from his bike and into an RTA pole &amp;ndash; the bike burst into flames, investigators said.&lt;/p&gt;
&lt;p&gt;According to witnesses, the motorcyclist was speeding and not wearing a helmet. The second driver will not be cited.&lt;/p&gt;
